On Sept. 20, 2010, China Academy of Wealth Planning and Management (CAoWPM) coordinated with the Mossack Fonseca Corporation and the Orion House to hold the forum ”Internationalization Strategy & Practice of Chinese Enterprises” in Qingdao, Shandong province. Mr. Zhang Xiaodong, the Chairman of CAoWPM, gave a lecture concerning the current situation of wealth planning and management in China and its future trend. Especially Mr. Zhang elaborated on the important roles that trust, private foundation and offshore company play in wealth planning. On July 3, 2010, Mr. Austin Zhang, Chairman of CAoWMP, was invited by Hong Kong University to give a speech on Asia Trust Symposium. His topic is Wealth Planning in Hong Kong. The topic analysed combined use of private foundation, trust and offshore company in one structure and their legal support. Some 50 top professors, researchers and bankers from Hong Kong, Mainland China, Taiwan, Japan and Korea participated in the symposium. May 15-16, 2010, Mr. Austin Zhang, the Chairman of China Academy of Wealth Planning and Management, was invited to participate in the Symposium on Property Law of Hongkong, Macau, Taiwan and Mainland, 2010. It is jointly held by Law Dept. of National Chung Cheng University and Taiwan Property & Economic Law Institute. The top experts focused on the fields of property law, trust law, security law, IP law and immovable property law, etc. Mr. Austin Zhang gave a speech named the Law Practice of Family Assets Protection regarding Real Estate Gift. On April 7-8, 2010, China Academy of Wealth Planning and Management (CAoWPM) respectively hold free talks named “Application of Law & Practice for International Wealth Planning” in cooperation with Finance Association and Association of Legal Science of Huazhong University of Science and Technology and Wuhan University Institute of International Law. Pro. Xiao Yongping, Dean of the Law School of Wuhan University, the Honorary Chairman of CAoWPM presided over it. Mr. Zhang Xiaodong, the Chairman of CAoWPM, gave the lectures. The attendants were candidates for M D and Ph. D, as well as senior students of B. D. Mr. Zhang analysed the basic concepts, typical cases and applyment, such as trust, private foundation and offshore company, of wealth management. Mr. Zhang also offered the prospects and advices to those who were willing to work in the filed of wealth planning. It was the first success in our attempt to partner with universities. In January 2010, Prof. Xiao Yongping, the Honorary Chairman of CAoWPM, Dean of the Law School of Wuhan University, visited Hong Kong. During his visit, the Chairman Mr. Austin Zhang stated the achievements we obtained in 2009 and our strategy planning in 2010. CAoWPM will hold a seminar together with Wuhan University, aiming to expand our influence in universities and spread the philosophy of wealth management to master/doctor candidates. Prof. Xiao will be supportive for the meaningful activity. In January 2010, Mr. Peter Tay, the Council Member of CAoWPM and the Chairman Mr. Austin Zhang met in Hong Kong to discuss the strategy planning in Singapore. Our website traffic data reveals that the number of Singaporean visitors is ever-increasing. There is a growing concern over trust and private foundation in Singapore. Seminars are planned to be held in cooperation with private banks and venture capital firms in Hong Kong and Singapore. In December 2009, Mr. Austin Zhang, Chairman of China Academy of Wealth Planning and Management met with our Council Members Mr. Kong Wei and Ms. Li Jianglian in Shanghai and Guangzhou respectively. They talked about the prospect for the development of wealth management in China. Although the amount of wealth in China keeps rising, assets protection is still in early stage. Therefore, CAoWPM is planning to hold a serial of seminars and conferences at law firms and corporations in 2010, spreading the philosophy of wealth planning and management. In September 2009, Mr. Huang Yaying, the Standing Vice-Chairman of CAoWPM, Law professor of Shenzhen University, Supervisor of Master Degree Candidate was appointed to be Dean of the Law School of Shenzhen University. Prof. Huang is also the Standing Council Member of Chinese Society of Private International Law, the Standing Council Member of China Academy of Arbitration Law, the Council Member of Chinese Society of International Law, and Arbitrator of Shenzhen Arbitration Commission. He is engaged in the research on International Private Law, International Trade Law and Arbitration Law. In September 2009, Mr. Christoph Zollinger, the Honorary Advisor of CAoWPM had a meeting with the Chairman Mr. Austin Zhang when in Hong Kong. They reviewed the development strategy of CAoWPM and discussed how to strengthen the connection with overseas members. In line with our strategy, we will focus on European market, where the field of wealth management is much more advanced. Mr. Zollinger meant he would cooperate in overseas promotion. In July 2009, Mr. Austin Zhang, Chairman of CAoWPM, was invited to make a speech titled China’s New Corporate Income Tax Law and Assets Protection for the members of The Society of Chinese Accountants & Auditors in Hong Kong, who were all certified public accountants. To help affluent clients manage their wealth, professional knowledge was of necessity. In addition, Mr. Zhang represented the ways of assets protection and its developing trend. The speech obtained some positive effects on promoting the connection with accountants. In November 2009, Liu yuanshan, Post-doctoral of Law, Professor of Law in Hainan University, Master tutor in Civil and Commercial Law, accepted the invitation to be a council member of CAoWPM. His research interests include Intellectual Property law, Corporation and Securities Law and Law Application of Foreign-related Civil and Commercial Matters. He has written a dozens of books on related issues and more than two dozens of research articles have been published. In October 2009, Xiang zaisheng, PhD in law, Associate Professor of International Private Law in Zhongnan University of Economics and Law, accepted the invitation to be a council member of CAoWPM. He is the council member of China Society of International Private Law and Hubei Province Society of international law. His articles have been published on some academic journals, such as China Legal Science. In July 2009, Ramsés Owens, Partner of Mossfon Trust Corporation, accepted the invitation to be a council member of CAoWPM. Mr. Owens obtained his Law degree at the University of Panama and a Bachelor of Arts in Business Administration at Santa Maria La Antigua University. He is also the member of Panama Bar Association, the International Tax Planning Association, the International Lawyers Association and the Panama Branch of the Society of Trust and Estate Practitioners (STEP). In July 2009, the second edition of Guide to Offshore Practice written by Mr. Austin Zhang, the chairman of China Academy of Wealth Planning and Management, Doctor of International Private Law (Wuhan University), Asia Partner of Mossack Fonseca & Co. (attorney-at-law), was published. It expands on the first edition by adding the content of tax law, trust and private foundation as well as the research in banking and finance of Taiwan and the latest development on the policies and regulations in relevant fields. It covers the offshore related policies, the fundamental principles of trust and private foundation, international investment and taxation, accounting and international trade, corporation establishment and management, and related matters. This book provides practical advice on how to use offshore structures legally. February 19, 2009, Prof. Huang Jin, the Permanent Honorary Chairman of China Academy of Wealth Planning and Management (CAoWPM), the former Vice-President of Wu Han University, was formally appointed as President of China University of Political Science and Law. Prof. Huang is the first one who obtained doctoral degree on Private International Law in mainland China. He is a renowned scholar and educator in the field of Private International Law, especially in the State and its Property Immunities, Interregional Conflict Law, International Commercial Arbitration, and Theory and Practice of Chinese Private International Law. In Dec. 2008, Mr. Austin Zhang, the Chairman of China Academy of Wealth Planning and Management, was invited to the TV program Qiantang Forum, produced by Hangzhou TV. Mr. Zhang gave Chinese enterprises suggestions on how to make brands valuable, how to convert business principles and how to determine overseas development strategy. Nov.8, 2008, Xihu Fortune Forum was held by Mossack Fonseca & Co., together with Orion House Services (HK) Limited, Hangzhou Foreign Trade & Economic Cooperation Bureau, as well as China Academy of Wealth Planning and Management (CAoWPM). The Chairman of CAoWPM, Mr. Austin Zhang, the Council Members Mr. Zhai Jiguang and Mr. Franck Chen made keynote speeches at the Forum. The Forum was the first one that specialized in asset protection, planning and management held in Hangzhou. Sept. 27, 2008, Mr. Austin Zhang, the Chairman of China Academy of Wealth Planning and Management (CAoWPM), Asia Partner of Mossack Fonseca & Co. (attorney-at-law), and Mr. Zhai Jiguang, PhD of Law of Peking University, Associate professor of China University of Political Science and Law, Council member of CAoWPM, were invited to the Advanced Forum on the Going Out of Chinese Enterprises, held by Shanghai Pudong Development Bank and the Government of Jiangsu Province. As the invited speakers, they made fabulous speeches respectively on the Chinese Enterprises’ New Thoughts of “Going Out” and the Impacts of New Corporate Income Tax. In Sept. 2008, Mr. Franck Chen, the Head of Barclays’ wealth intermediary business in Hong Kong, accepted the invitation to be a Council Member. Mr. Chen started his career in a management consulting company in Paris after he had obtained his doctoral degree, and moved into banking industry as a Credit Analyst in late 1993. Since then, Mr. Chen has been working with a number of major European banks in both Hong Kong and China as a senior banker. He is very experienced with exposure to various industries in dealing with local trading companies, listed companies and multinationals as well as financial institutions. In May 2008, the traditional Chinese edition of Guide to Offshore Practice was published in Taiwan. The book was written by Mr. Austin Zhang, the Chairman of China Academy of Wealth Planning and Management, Asia Partner of Mossack Fonseca & Co. (attorney-at-law). Compared with the simplified Chinese version, it added Mr. Zhang’s recent research on private foundation, trust, wealth planning and banks and taxation in Taiwan. In April 2008, Mr. Austin Zhang, Chairman of China Academy of Wealth Planning and Management (CAoWPM), and Mr. Huang Yaying, Standing Vice-Chairman of CAoWPM were invited to participate in Cantonese Enterprises General Counselor Forum, which was held mainly by State-Owned Assets Supervision and Administration Commission of Guangdong Provincial together with Guangdong Small and Medium Enterprise Bureau. The topic is “Law Practice and Risk Prevention of Capital Operation”. Mr. Huang Yaying made a theme speech at the forum. In Apr.2008, Detailed Explanation and Practical Application Manual to Up to Date Taxation Policies was published by Publishing House of Electronics Industry. The authors are: Zhai Jiguang, PhD of Law of Peking University, Associate professor of China University of Political Science and Law, Council member of China Academy of Wealth Planning and Management; and Austin X. D. Zhang, Chairman of China Academy of Wealth Planning and Management, PhD of Laws of Wuhan University, Asia Partner of Mossack Fonseca & Co. The book contains three volumes, and, with practical case study, gives detailed explanation to new enterprise income tax law, as well as the employment of enterprises. In early Dec.2007, Interpretation, Practical Guide and Case Study for Regulations for the Implementation of the Law of the PRC on Enterprise Income Tax was published by Lixin Accounting Publishing House. The authors are: Zhai Jiguang, PhD of Law of Peking University, Associate professor of China University of Political Science and Law, Council member of China Academy of Wealth Planning and Management; Yi Yunhe, former Director of Income Tax Department of State Administration of Taxation; and Austin X. D. Zhang, Chairman of China Academy of Wealth Planning and Management, PhD of Laws of Wuhan University, Asia Partner of Mossack Fonseca & Co. The book, totally amounting to 430,000 characters, contains eight chapters: General Provisions, the Taxable Income, Payable Tax, Preferential Tax Treatment, Tax Withheld at Source, Special Tax Payment Adjustment, Administration of Tax Levying and Collection and Supplementary Provisions, etc. In July 2007, Prof. Guo Yujun, Law Professor of Wuhan University, Supervisor of PhD Degree Candidate in Law, accepted the invitation to be an Honorary Advisor. Prof. Guo is also the Director of Private International Law research office, the Vice-President and General Secretary of Chinese Society of Private International Law, the Executive Editor of Chinese Yearbook of PIL and Comparative Law. In June 2007, Mr. Kang Rongping, Director of Center for Overseas Chinese Research, Chinese Academy of Social Sciences, accepted the invitation to be a Council Member. Mr. Kang Rongping is also the Consultant for Peking Administration, Standing vice Chief Editor of Yearbook of the World Chinese Entrepreneurs, Standing Council Member China International Economic Relations Association, Council-President of PECC Industries Committee, Council Member of Global M&A Research Center. In June 2007, Professor Chen Yun, Professor of School of Economics and Management, Tsinghua University, accepted the invitation to be a Council Member. Professor Chen Yun is also a Doctor in Economics of University of California, Berkeley, Doctor in Business Administration of University of Southern California, Vice-director of China Center for Financial Research, Tsinghua University, Senior Consultant of Roland Berger Strategy Consultants, and Chief fellow of China Academy of Management Science. In June 2007, Mr. Ke Yinbin, Vice-director of Center for Overseas Chinese Research, Chinese Academy of Social Sciences, accepted the invitation to be a Council Member. In Mid Apr. 2007, Pro. Lusina Ho (Hong Kong University) has accepted the invitation to be an Honorary Advisor. Pro. Ho teaches and researches in Equity, Trusts, and Restitution, and publishes widely and internationally in these areas. She has been consulted by the Chinese government on the drafting of the Chinese Trust Law, and is the author of Trust Law in China (Sweet & Maxwell, 2003). In Mid Apr. 2007, Kong Wei, senior partner of Zhong Lun Law Firm accepted the invitation to be a Council Member. Mr. Kong is a member of IPBA and an Independent Director of Everbright Pramerica Fund Management Co., Ltd.
